The legal representatives of Robson Rodrigues, also known as Robinho, have petitioned for the case to be reviewed by the Federal Supreme Court. They argue that several Brazilian legal provisions have been breached, notably the prohibition against Brazilian citizens serving sentences within the country based on judgments by foreign authorities.
The defense maintains that the 2017 Immigration Act, which came into effect after the 2013 case, is the legal framework that permits the enforcement of sentences in Brazil. Following the approval of the defense's request by the São Paulo court in January of this year, the prisoner's sentence has been reduced by a total of 160 days.
